• User Account: Your registered account on the Zyvavo platform
• Credits: Virtual currency used to access premium features within our Services
• Content: Any files, data, text, images, or other materials uploaded or generated through our Services
• Platform: The Zyvavo website and all associated applications

3. Eligibility

To use our Services, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our Services under applicable laws
• Provide accurate and complete registration information
• Maintain the security of your account credentials

Users under 18 must have parental or guardian consent to use our Services.

4. Account Registration and Security

4.1 Account Creation

To access certain features, you must create an account by providing:

6. Credit System

6.1 Earning Credits

Zyvavo operates on a 100% free, ad-supported model. You can earn credits by:

• Banner Ads: +2 credits per view
• Full Screen Ads: +3 credits per view
• Video Ads: +5 credits per view
• Rewarded Videos: +10 credits per completion
• Surveys: +15 credits per completion
• Offer Walls: +50-500 credits per offer completion
• Sign-up Bonus: 100 free credits upon registration

6.2 Using Credits

Credits are required for premium features:

• Background Removal: 30 credits per image
• Image Upscaling: 30 credits per image
• Other premium features as specified in the tool interface

6.3 Credit Policies

• Credits have no monetary value and cannot be exchanged for cash
• Credits are non-transferable between accounts
• Credits do not expire unless your account is inactive for 12+ months
• We reserve the right to adjust credit values or requirements
• Fraudulent credit acquisition may result in account termination

6.4 Free Tools

Zyv-Wallpapers (Linux desktop app) is completely free with no credit requirements.

7. User Conduct and Prohibited Activities

7.1 Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms.

7.2 Prohibited Activities

You may NOT:

• Violate any applicable laws, regulations, or third-party rights
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble our Services
• Use automated tools (bots, scrapers) without permission
• Abuse the credit system or engage in fraudulent activities
• Upload illegal, offensive, or infringing content
• Harass, threaten, or harm other users
• Impersonate others or misrepresent your identity
• Resell or redistribute our Services without authorization
• Interfere with the proper functioning of the Services

8. Content and Intellectual Property

8.1 Your Content

You retain all ownership rights to content you upload. By using our Services, you grant us a limited license to:

• Process, store, and display your content as necessary to provide Services
• Use anonymized, aggregated data for service improvement

Important: We do NOT permanently store your uploaded files. All files are deleted immediately after processing.

8.2 Our Intellectual Property

All content, features, and functionality of our Services, including:

• Software, code, and algorithms
• Logos, trademarks, and branding
• Design, layout, and user interface
• Documentation and tutorials

are owned by Zyvavo and protected by copyright, trademark, and other intellectual property laws.

8.3 Generated Content

Content generated through our AI tools (edited images, documents, etc.) belongs to you. You may use it for personal or commercial purposes, subject to applicable laws.

8.4 Copyright Infringement

9. Privacy and Data Protection

Your privacy is important to us. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key Privacy Commitments:

• No Permanent File Storage: Uploaded files are deleted immediately after processing
• GDPR Compliance: We comply with data protection regulations
• Data Security: We use industry-standard encryption and security measures
• User Rights: You can access, correct, or delete your personal data

Our Services may integrate with or link to third-party services, including:

• Firebase/Google Cloud (authentication, database)
• Advertising networks (Monetag and partners)
• Analytics providers

We are not responsible for the content, privacy practices, or terms of third-party services. Your use of third-party services is subject to their respective terms and policies.

11. Disclaimers and Warranties

Our Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Fitness for a particular purpose

11.2 No Guarantee of Results

We do not guarantee that our Services will:

• Meet your specific requirements or expectations
• Produce specific results or outcomes
• Be error-free, secure, or uninterrupted
• Be compatible with all devices or software

11.3 User Responsibility

• Backing up your important data

12. Limitation of Liability

Our total liability for any claim arising from these Terms or your use of our Services shall not exceed the amount you paid us in the past 12 months (which is $0 for free users).

You agree to indemnify, defend, and hold harmless Zyvavo and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your content or conduct on the platform
• Any fraudulent or illegal activities

14. Termination

14.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in your dashboard

14.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your account is inactive for an extended period
• Required by law or legal process

14.3 Effect of Termination

Upon termination:

• Your access to Services will be revoked
• Your account data may be deleted
• Unused credits will be forfeited
• Provisions that should survive termination will remain in effect

15.2 Arbitration

Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration, except where prohibited by law.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
